Agreement to terms
By accessing and using Pinin's AI-powered photo restoration services ("Service"), you accept and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms in their entirety, you may not access or use our Service.

User accounts and registration
Account creation requirements

Prohibited system activities
- Attempting to reverse engineer, hack, or circumvent our systems and security measures
- Using automated tools, bots, or scripts to access our services without explicit permission
- Interfering with, disrupting, or overloading our services, servers, or network infrastructure
- Creating multiple accounts for fraudulent, deceptive, or system abuse purposes
- Reselling, redistributing, or sublicensing our services without proper authorization
- Attempting to gain unauthorized access to other users' accounts or data

Payment terms and billing

- All payments are processed securely through Stripe, our certified payment processor
- Prices are displayed in the currency shown at checkout and include applicable taxes where required
- Payment is required in full before service delivery for one-time purchases
- We reserve the right to modify pricing with at least 30 days advance notice to existing customers
- Enterprise customers may be eligible for custom pricing and payment terms
Subscription services and billing
- Subscription fees are billed automatically in advance on a recurring monthly or annual basis
- Cancellations take effect at the end of the current billing period with no partial refunds
- Failed payments may result in service suspension until payment is successfully processed

Service availability and performance
- Services are provided "as is" and "as available" without warranties of any kind

- We are not liable for service interruptions, downtime, or third-party service dependencies
- Internet connectivity and browser compatibility requirements apply
- We strive for 99.9% uptime but do not guarantee uninterrupted service availability

Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PININ SRL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, use, goodwill, or other intangible losses
- Damages resulting from unauthorized access to, use of, or alteration of your content
- Damages resulting from any conduct, content, or services of third parties
- Damages arising from our inability to provide services or service interruptions
- Damages related to the quality, accuracy, or results of restored images
- Business interruption, lost opportunities, or consequential commercial losses
AGGREGATE LIABILITY CAP: Our total liability to you for all claims arising from or relating to these Terms or your use of our services shall not exceed the greater of (a) €100 or (b) the total amount you paid to us for the specific service giving rise to the claim during the 12 months immediately preceding the claim.
Indemnification
You agree to defend, indemnify, and hold harmless Pinin SRL, its subsidiaries, affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, costs, liabilities, and expenses (including reasonable attorney fees and court costs) arising out of or relating to:
- Your use or misuse of our services or violation of these Terms
- Your violation of any applicable laws, regulations, or third-party rights
- Content you upload, process, or distribute through our services
- Any breach of your representations, warranties, or obligations under these Terms
- Your negligent or wrongful conduct in connection with the services
Termination and account closure
Termination by you
- You may terminate your account and these Terms at any time through your account settings
- Termination does not entitle you to refunds of prepaid fees or unused subscription periods
- You remain liable for all charges incurred before the effective date of termination
- Upon termination, your access to paid features will cease at the end of the current billing period
Termination by us
We may terminate or suspend your account immediately, with or without notice, if you:
- Violate these Terms, our policies, or acceptable use guidelines
- Engage in fraudulent, illegal, or harmful activities
- Pose a security risk to our systems, infrastructure, or other users
- Fail to pay required fees or charges when due
- Provide false information or misrepresent your identity
- Abuse our services or attempt to circumvent usage limitations
Governing law and jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms.
Any legal action, suit, or proceeding arising out of or relating to these Terms or the services shall be brought exclusively in the competent courts of Milan, Italy. You hereby consent to the personal jurisdiction of such courts and waive any objection to venue.
EU consumer rights: Nothing in this section limits any mandatory consumer protection rights you may have under applicable European Union or member state consumer protection laws.
International users and compliance
Our services are available internationally, and we comply with applicable data protection, consumer protection, and privacy laws in jurisdictions where we operate. Users outside Italy acknowledge and agree that their information may be transferred to, processed, and stored in Italy and other countries where our service providers operate.

Arbitration proceedings, if agreed upon, shall be conducted in English in Milan, Italy, under the rules of the Milan Chamber of Arbitration.

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
